Supreme Court Nixes Louisiana Pro-Life Reform

In other words, Kavanaugh would let play out in Louisiana what originally played out in Texas before the Supreme Court eventually blocked HB 2-and thousands of people who needed abortions would have found themselves scrambling or unable to access them entirely.

The law at issue, Act 620, would require any physician providing abortion services in Louisiana to have admitting privileges at a hospital within 30 miles of the procedure.

That's because as it stands now, state laws are not allowed to place an "undue burden" on a woman's right to choose, putting so many obstacles in her path that it becomes hard or impossible for her to exercise her rights.

Thursday's decision offers a temporary reprieve for abortion rights advocates-especially in Louisiana, where the law would have winnowed the number of abortion providers in the state down to one. For instance, a convicted bank robber can appeal to a circuit court, but not on the basis that she didn't do it because she was in another city at the time of the robbery: That question has already been decided at the trial court level: She was at the bank.

The emergency actions announced late Thursday showed Chief Justice John Roberts siding with the court's liberals - for now - in blocking a restrictive Louisiana abortion law and keeping the status quo in place.

The law was backed by conservative judges Neil Gorsuch and Brett Kavanaugh - both picked by President Donald Trump. Only one of the doctors has admitting privileges at a nearby hospital. A divided panel of the conservative Fifth Circuit reversed the lower court, finding that the law would not have as much of a negative impact on abortion access as with Texas.

But Kavanaugh's decision on the Louisiana law appears to run counter to one the court made recently about a similar Texas law, a move that convinced pro-choice supporters to express alarm that Roe could be in trouble. He said Louisiana had offered the equivalent of a 45-day grace period, in which doctors could have redoubled their efforts to obtain admitting privileges. Some of those measures, which provide for late-term abortion in the cases where the health of the mother is in jeopardy, have generated fierce opposition from anti-abortion groups. Kavanaugh said the doctors would continue to be allowed to perform abortions during the 45-day period and would be given leeway by regulators to comply with the law. Plaintiffs, however, have argued that two of the state's three clinics would close if the law took effect.
