U.S. federal judge strikes down Obamacare as unconstitutional

Republicans Say Little About Obamacare Ruling

A federal judge's ruling late Friday striking down the Affordable Care Act in its entirety has stoked anxiety among millions of Americans who rely on subsidized health insurance and millions more who have pre-existing conditions.

Klobuchar says the ruling Friday by the Texas judge contradicts the 2012 ruling by the U.S. Supreme Court that upheld the constitutionality of the Affordable Care Act.

He concluded the individual mandate "can no longer be fairly read as an exercise of Congress's Tax Power and is still impermissible under the Interstate Commerce Clause - meaning the Individual Mandate is unconstitutional", adding that the mandate is inseparable from the rest of the law. The judge agreed with the suit's argument that the law should be struck down because Congress past year repealed the tax penalty that enforced a mandate that most Americans get health insurance. O'Connor's decision said that without that penalty, the law no longer met that constitutional test. O'Connor wrote in the opinion that DOJ was arguing that "the individual mandate is unconstitutional and inseverable from the ACA's pre-existing-condition provisions". His ruling is likely to be appealed, possibly up to the Supreme Court, which has twice - in 2012 and 2015 - upheld the Affordable Care Act.
