Qualcomm Granted Injunction Against Apple Chinese Court Rules

United States chip-maker Qualcomm claims it has won an injunction against Apple that effectively bans the import and sale of a number of iPhone models, ranging from the iPhone 6S to the iPhone X.

Apple released a statement saying "all iPhone models remain available for our customers in China".

The week after the U.S. arranged the arrest of a Huawei exec China has granted Qualcomm an injunction prohibiting the sales of most Apple smartphones in the country.

He said the ban will be hard to enforce and won't likely have a significant effect on Apple's sales.

That would give Chinese smartphone brands, such as Huawei, "more opportunities in the high-end market", he told AFP.

Apple argues iPhones now found in stores in China have been running iOS 12, which does not violate Qualcomm patents. iOS 12 changes the way users resize photos and manage applications on their screens that allows Apple to get around the Qualcomm patents.

Apple and Qualcomm are also suing one another in several separate patent disputes.

Some Chinese netizens and companies have also turned against Apple. It creates uncertainty over Apple's business in one of its biggest markets at a time when its falling share prices reflect concerns over waning demand for new iPhones.

But Apple s premium-priced products remain out of reach for many users, increasing the appeal of more affordable phones produced by local companies. In other words, it will be nigh impossible to buy anything but the current generation iPhone once the existing stocks of the older iPhones run out in China.

This is just one of the many legal battle that Apple and Qualcomm are fighting, and this might be the best tool to get Apple back to a serious negotiation table. These are software patents and Apple claims that iOS 12 does not violate them.

Chip-maker Qualcomm claims it has been granted two injunctions against Apple in China that prevent the sale of a range of iPhone handsets in the country. "The orders aren't specific to the operating system installed on the phones", said Don Rosenberg, general counsel and executive vice president of Qualcomm, in a statement to Yahoo Finance.

The Fuzhou Intermediate People's Court in China sided with Qualcomm's argument that Apple's iDevices infringe its patents related to resizing images and using touch-based navigation apps.
