Booker releases Kavanaugh emails on racial profiling

Piper Perabo

But Kavanaugh dodged Democratic Senator Dianne Feinstein's question about whether a sitting president can "be required to respond to a subpoena", a query that could come into play as Special Counsel Robert Mueller investigates potential collusion between Trump's 2016 presidential campaign and Russian Federation.

He made clear earlier Wednesday that he believes that "no one is above the law".

"I'm asking you a very direct question - yes or no?"

"I have ruled sometimes for the prosecution and sometimes for criminal defendants, sometimes for workers and sometimes for businesses, sometimes for environmentalists and sometimes for coal miners". The late conservative legal scholar Robert Bork, for instance, totally rejected the idea that there could be anything like a constitutional right to privacy. He says, "the signs and signals are plain".

On abortion, Kavanaugh said the landmark 1973 Roe vs. Wade decision that ensures access to abortion has been affirmed "many times".

The questioning of Kavanaugh has carried strong political overtones ahead of the November congressional elections.

In the email, obtained by the PBS NewsHour, Kavanaugh was reviewing an op-ed in support of a Bush judicial nominee.

If confirmed, Kavanaugh is expected to move the court, which already had a conservative majority, further to the right. He also echoed some of what Sasse said about Supreme Court justices not acting based on politics or policy preferences, but on the law, regardless of its outcome.

Thursday's session began with Democrats on the committee in open revolt over the handling of documents from Kavanaugh's tenure in the George W. Bush White House.

While campaigning for the presidency, Mr Trump promised to appoint pro-life judges, raising the possibility of Roe v Wade being overturned. Richard Blumenthal of CT to pledge to step aside from any Supreme Court cases dealing with Trump and Mueller's investigation.

Harris seemed unconvinced by Kavanaugh's reaction. He added that he would need to see a list of the firm's lawyers. "I don't recall any inappropriate conversations about the investigation", he said.

Harris promised to follow up with Kavanaugh on the topic.

Those views could inform which side Kavanaugh, should he become a Supreme Court justice, might take if the presidential-indictment question reaches the court.

"The fundamental problem in this case is that these DOT regulations use a lot of legalisms and disguises to mask what is a naked racial set-aside", wrote Kavanaugh in the 2003 email.

Democratic Rep. Cedric Richmond of Louisiana, the group's chairman, says Kavanaugh would weaken protections under the Voting Rights Act.

Kavanaugh's defenders say his ruling resolved the case, as the Justice Department under President Barack Obama chose not to appeal.

Cornyn criticized Senate Democrats' "high jinks" after they invoked a rarely enforced rule to shut down Senate floor proceedings at 1:16 p.m.in protest of the confirmation hearings.

The memo, marked 'Committee Confidential, ' was leaked to the New York Times.

Sen. Cory Booker (D-N.J.) said Thursday he is going to "knowingly violate" the rules to release one of the emails regarding "racial profiling". John Cornyn derisively snipped that "running for president is no excuse for violating the rules of the Senate".

McConnell didn't give any guidance when he made the move about why he was making the request or when the Senate would come back into session. Several Democrats said in response, "bring it on".

US President Donald Trump's choice for the Supreme Court questioned whether a ruling legalising abortion was settled law, emails show.

Kavanaugh said the case "is an important precedent of the Supreme Court that has been reaffirmed many times". The email was sent to a Republican Senate aide. The document is partially redacted.

Day two of the Brett Kavanaugh hearings were once again riddled with theatrics.

Senate Democrats challenged his record on hot-button issues such as abortion, affirmative action and presidential power.

Trump says he's pleased with his nominee's performance, and Republicans are united behind him.
