NY regulators revoke Charter merger, tell them to leave

NYS moves to kick Charter Communications out of state

Officials argue the cable giant hasn't met the terms agreed upon with the state during its 2016 merger with Time Warner Cable.

"Charter, doing business as Spectrum, has - through word and deed - made clear that it has no intention of providing the public benefits upon which the Commission's earlier approval was conditioned", a PSC news release stated. That action was expected to be filed Friday in state Supreme Court in Albany.

The commission alleges Charter has repeatedly failed to meet deadlines for improving internet speeds and has attempted to skirt obligations to provide high-speed internet to rural communities. Nationwide, Charter has 26 million customers, and the company would continue to own former Time Warner Cable systems in states besides NY. We'll see how Charter responds and what actually comes of this, but with more than 2 million subscribers to Charter in NY, it's going to have a major impact on the television and internet landscape there.

On Jan. 8, 2016, the PSC approved Charter's acquisition of Time Warner. As such, the commission concludes that it can no longer allow the company to operate in NY in good faith.

The commission said the US broadband provider failed to live up to its agreement as part of the merger to build internet access to an additional 145,000 households and businesses in rural areas of NY under-served by internet providers.

Regulators in NY are reneging on their approval of Charter Communications acquisition of Time Warner Cable, alleging the cable provider broke its promise to deliver high-speed broadband to rural customers. As a result of Charter's adamant refusal to abide by the conditions of the merger approval, the Commission ordered Charter to develop a transition plan. "After more than a year of administrative enforcement efforts to bring Charter into compliance with the Commission's merger order, the time has come for stronger actions to protect New Yorkers and the public interest", said Commission Chair John B. Rhodes.

Charter has 30 days to contest the order, and the company said it plans to fight the decision. Rather than accept responsibility Charter has tried to pass the blame for its failure on other companies, such as utility pole owners, which have processed tens of thousands of pole applications submitted by Charter.

In a statement, Charter spokesman Andrew Russell accused the commission's actions of being politically motivated. It also hit the company with a $1 million penalty Friday, adding to $2 million in fines it levied against Charter last month.

"We need to seek a different provider", he said.
