Trump says he'll name high court pick on July 9

Justices are supposed to be above partisan politics. They aren't even in retirement

The strategy mirrors one Mr Trump has been pursuing for appointments to the lower courts, where younger than normal judges have often been selected.

In a tweet today, the president said he will be making his choice for supreme court justice on July 9th.

The nine-point difference could suggest an enthusiasm gap between the parties, as liberal groups sound the alarm that a newly configured court could outlaw abortion rights if a conservative nominee replaces Kennedy's swing vote.

"I think the list is very outstanding", Trump said. The pick could further shift the court to the right and solidify its conservative bent for years or even decades. "We have to pick one that's going to be there for 40 years, 45 years". With Trump's approval ratings at 41 per cent he's said it's no surprise the president is trying to highlight the Supreme Court vote to push voters to the polls. Moreover, the court overruled a 41-year-old precedent that allowed public employee unions to collect fees from non-members, a decision viewed as a major blow for Democrats.

A key Democratic senator is urging President Donald Trump not to pick a Supreme Court nominee who's openly interested in overturning Roe v. Wade.

"The Supreme Court could do quite a lot of damage to the right recognized in Roe without ever formally overruling it, simply by upholding state laws that make it harder and harder for women to obtain abortions without banning them", Vladeck said.

"I've got it narrowed to about five", he said.

Many believe one female candidate could be U.S. Court of Appeals for the 7th Circuit Judge Amy Coney Barrett. Justice Anthony Kennedy, who announced his retirement on Wednesday, had sided with the court's four liberal justices on both issues.

Undoing or at least putting more limits on that ruling has been a dream of conservative activists and contributed to conservative Christian support for Trump that helped him win the presidency in 2016. President Barack Obama's nomination of Judge Merrick Garland was held up by McConnell, who cited the upcoming presidential election. Kennedy wrote the landmark 2015 ruling that legalized same-sex marriage nationwide and has backed limitations on the application of the death penalty.

While Trump did not make rolling back abortion rights a central plank of his campaign, numerous conservative rank and file want Roe v. Wade overturned and Trump promised to put anti-abortion justices on the Supreme Court.

"The American people should have a voice in the selection of their next Supreme Court justice". With only 99 senators now voting, the nominee can be approved by a 50-49 margin. The Senate votes to confirm or deny judicial candidates for federal courts, including Supreme Court nominees.

But Republican Senator John McCain, who has an aggressive form of brain cancer, has been absent from the Senate for months, meaning that if all Senate Democrats vote against Trump's eventual nominee, it would take only one Republican defection to defeat his pick.

"The fact that there's a modest enthusiasm disadvantage isn't all that meaningful because there's already an enthusiasm gap for Republicans", he said, noting Democratic anger toward Trump. And the president, in the moments after Kennedy's retirement was announced, made clear that he understood the opportunity to shape the court for generations.

Among them: Leonard Leo, who is on leave from the Federalist Society; John Malcolm of the Heritage Foundation; and attorney Don McGahn, now the White House counsel.
