Supreme Court Upholds Donald Trump’s Travel Ban 3.0, Says POTUS ‘Possesses An Extraordinary Power’

The U.S. Supreme Court has ruled 5-4 that banning entrants to the United States from a list of mostly Muslim countries does not violate the Constitution.

The 5-4 ruling, with the conservative justices in the majority and the liberal justices dissenting, ended a fierce fight in the courts over whether the policy amounted to an unlawful Muslim ban, while confirming broad presidential powers over immigration and national security policy.

Previous versions of the ban, which limited travel to the US from Muslim-majority countries, had been blocked by lower courts, with plaintiffs alleging unconstitutional anti-Muslim bias.

In its ruling, the justices determined that President Donald Trump was within his authority when he blocked travel from seven countries, most of which are predominantly Muslim.

But in the majority opinion on Tuesday, chief justice John Roberts argues that those statements are irrelevant, and cites a 12-page report from the White House that outlines information-sharing, documentation, and consular-processing issues in the restricted countries. "We express no view on the soundness of the policy", he added.

The Trump administration has not publicly discussed any plans for future travel bans targeting additional countries. And in doing that, he said, and by the way, we want to do one other thing; we have a bunch of briefs in this case from people who analogize this ban to the Korematsu case during World War II, which upheld.

"Assaulting basic freedoms and rights by attacking marginalized groups and stoking fear is not new in our history", the group said. It restricts travel and emigration by people from five Muslim-majority nations: Iran, Libya, Syria, Yemen and Somalia - plus Venezuela and North Korea.

"The AAMC will continue its efforts to educate legislators about the direct link between fair immigration policies and the health of Americans, and to advocate for immigration policies that recognize the critical role that health professionals from other countries play in safeguarding our nation's health security", he said.

In a scathing dissent, Justice Sonia Sotomayor said a "reasonable observer" would conclude the travel ban was motivated by "anti-Muslim animus". He dismissed the many anti-Muslim statements Trump has made as "extrinsic statements".

The travel ban was one of Trump's signature hardline immigration policies that have been a central part of his presidency and "America First" approach.

The decision - which follows a court hearing in April - is the culmination of a battle that began just days after Trump took office in January 2017.

But keep in mind that Trump openly campaigned on some version of a travel ban. It also applies to North Korea and Venezuela, but those provisions were not challenged in court. And those are being challenged in the lower courts.

"At the same time, we align with the sentiment expressed by the US Travel Association and other industry leaders that an overt message welcoming legitimate worldwide travellers to the United States should accompany any security steps aimed at terrorists".

After a more moderate version of the two GOP proposals failed on Thursday and two delays on the Republicans' "compromise" bill, pressure is on the president's party to finally deliver a fix to the country's immigration problems, including controversial family separations along the USA border.

"The government has set forth a sufficient national security justification to survive rational basis review". The Supreme Court allowed the order to go into effect in December, while the legal case was pending.

In a significant case for organized labor, the court's conservatives indicated opposition during arguments on February 26 to so-called agency fees that some states require non-members to pay to public-sector unions. This was the third version of the ban twice struck down by courts as the president narrowed its scope and added a non-Muslim country. We are disappointed they ignored statements on how the ban will affect Muslim people and the message it sends to people. Individual plaintiffs who joined the case with Hawaii also say it separates them from family members who applied for visas to enter the country.
